The purpose of this Personal Data Protection and Processing Clarification Text (Clarification Text) is to fulfill the obligation of informing according to Article 10 of the Personal Data Protection Law No. 6698 (Personal Data Protection Law - KVKK) regarding the personal data obtained during the use of the website https://co2manager.eu/tr-tr or received from third parties.

  1. DATA CONTROLLER With this Personal Data Protection and Processing Clarification Text ("Clarification Text"), we, as Ethic Metal Recycling Industry and Trade Joint Stock Company ("Company" or "Ethic Metal"), wish to inform you, our valued customers, in accordance with our obligation under the Personal Data Protection Law No. 6698 ("KVKK") as the Data Controller.

  2. DEFINITIONS The following terms used in this Clarification Text refer to the following:

  • Data Subject: The natural person whose personal data is processed.

  • Law: Personal Data Protection Law No. 6698.
  • Personal Data: Any information related to an identified or identifiable natural person.

  • Authority: The Personal Data Protection Authority.
  • Regulation: Regulation on the Procedures and Principles of Application to the Data Controller, published in the Official Gazette dated 10/03/2018, no. 30356.
  • Data Controller: The natural or legal person who determines the purposes and means of processing personal data and is responsible for establishing and managing the data filing system.

LEGAL GROUNDS AND METHODS OF COLLECTING PERSONAL DATA In compliance with Articles 4 and 5 of Personal Data Protection Law No. 6698, our company processes your personal data in a lawful and fair manner, for the specific, clear, and legitimate purposes listed below. We base the processing of your data on the legal grounds of "obligations of the data controller," "necessary for the establishment or protection of a right," and "necessary for the legitimate interests of the data controller, provided it does not harm the fundamental rights and freedoms of the data subject." For online visitors, data such as cookies, browsing information, device data (ID), and traffic data are processed for ensuring information security, preventing misuse, conducting legal obligations, and ensuring compliance with relevant authorities and regulations.

These personal data may also be processed based on your explicit consent or in cases where the KVKK allows such processing without consent, as specified in the law.

  1. HOW LONG DO WE PROCESS YOUR PERSONAL DATA? We retain your personal data for as long as necessary to fulfill legal obligations, to protect the company's legal rights, or as required by applicable laws. After the necessary retention period, the data will be deleted, destroyed, or anonymized.

  2. YOUR RIGHTS UNDER KVKK ARTICLE 11 AND EXCEPTIONS According to Article 11 of the Personal Data Protection Law, you have the following rights:

  • Learn whether personal data is being processed
  • Request information about the purposes of processing and whether they are being used appropriately
  • Request correction of incomplete or incorrect data
  • Request the deletion or destruction of personal data if the reasons for processing cease
  • Object to automatic processing leading to adverse consequences
  • Request compensation if you suffer damage due to unlawful processing.

However, the right to request compensation is limited in cases defined under Article 28 of the KVKK, such as when processing is necessary for crime prevention or public interest.
